Terms of Service

Access to and use of services by The Derenco Agency LLC (and it’s website properties www.TheDerencoAgency.com and www.WriteYourBook.tips) are subject to these terms & conditions (herein referred to as “Terms”) and all relevant laws. By accessing any areas of these websites and/or contracting and paying for any services offered on the websites or by verbal agreement with a currently authorized agent of The Derenco Agency LLC, you agree to be bound by these Terms. If you do not agree to the terms and conditions of this agreement, you should immediately cease all usage of our website and/or services. Any Non-Human Visitors to our website shall be considered agents of the individual(s) who controls, authors or otherwise makes use of them. The access rights granted to you under the Terms of Service are non-transferable without our express written permission.

The Derenco Agency LLC reserves the right, at any time, to modify, alter, or update the terms and conditions of this agreement without prior notice. Modifications shall become effective immediately upon being posted on the Sites. We may also edit, revise, move/delete portions of, or add to the Sites from time to time. Your continued use of our websites and/or services after amendments are posted constitutes acknowledgmentment and acceptance of the Agreement and its modifications. Except as provided in this paragraph, this Agreement may not be amended.

Anti-Discrimination Policy

The Derenco Agency LLC does not and shall not discriminate on the basis of race, color, religion (creed), gender, gender expression, age, national origin (ancestry), disability, marital status, sexual orientation or military status in any of it’s activities or operations. These activities include, but are not limited to, hiring and firing of staff, selection of volunteers, interns, or vendors, and provision of services. We are committed to providing an inclusive and welcoming environment for all members of our staff, clients, volunteers, subcontractors, vendors and clients.

We do, however, reserve the right to refuse or terminate service to any prospect or client (or terminate a relationship with an employee, intern, volunteer or vendor) displaying threatening, harassing or otherwise difficult behavior, which would make a continued working relationship unhealthy for any or all parties involved.

Deposit Policy

A deposit is required to initiate all services. A deposit is either 100% of services valued at $499.99 or less, or 50% of all services valued at $500 or more.

Payment in full is required for all live events hosted or organized by The Derenco Agency LLC (paid webinars, digital courses, workshops, in-person events, etc.).

All deposits are non-refundable.

No exceptions will be made.

Making a payment in any form for any of The Derenco Agency LLC’s services or events denotes your awareness of and compliance with our Deposit Policy.

If this policy is not agreed with, we recommend not engaging us for any services.

Refund Policy

All sales are final.

The Derenco Agency LLC has a no-refund policy for all writing services, all consulting services and all events (paid webinars, digital courses, workshops, in-person events, etc.).

No exceptions will be made.

The Derenco Agency LLC strives to provide the most accurate advice through our website, content, courses, workshops and consulting services, as well as the highest quality of service for writing projects.

We adhere to current best practices in our industry when providing services and we strive to deliver the highest quality of work we can possibly offer at all times.

Due to the laborious, time intensive and digital delivery nature of our work in all lines of service, all sales are final and our ‘no refund’ policy shall stand.

All writing services are provided by a professional copywriter(s) and/or editor(s) with years of experience in marketing communications and career services. If you are not satisfied with the work provided to you, you agree to have it revised until you are happy, as outlined in our revision policy.

Making a payment in any form for any of The Derenco Agency LLC’s services or events denotes awareness of and compliance with our Refund Policy.

If this policy is not agreed with, we recommend not engaging us for any services.

Revision Policy

The Derenco Agency LLC maintains a generous revision policy for all writing services to compensate for our no-refund policy.

For all writing services, clients have 45 days after initial delivery of completed documents to request a revision of work we’ve provided at no charge. Requests made 46 days and beyond will incur a revision fee of 35% of the original contract value.

A maximum of five complimentary revisions will be allowed to guarantee happiness with service. Revisions requested beyond five times will incur a fee of 50% of the original contract value.

Revisons requested which result in a 50% or more change to or rewrite of the originally requested content will incur a fee which could range from 40 – 70% or the original price of service.

Monthly Retained Services

All sales of services offered on a monthly or retained base are binding and non-refundable.

By making an initial payment, this signifies your commitment to making all payments in a timely fashion for the duration of your contracted period.

The Derenco Agency LLC has a no-refund policy for all services. If you wish to terminate your services prior to the end of the contracted period, it must be done in writing. However, you will still be responsible for completing the remaining scheduled payments of your contracted term.

No exceptions will be made.

If this policy is not agreed with, we recommend not engaging us for any services.

Services Upgrade Policy

Certain services offered by The Derenco Agency LLC are offered at various levels at different price points. Upon completion of a service, clients have 30 days to request an upgrade to a higher service level.

Clients will only be asked to pay the difference between the higher and original service they requested.

Upgrade requests made 31 days and beyond after initial completion of service will be subject to the full price of the higher service.

Satisfaction Guarantee

The Derenco Agency LLC guarantees your satisfaction with your final resulting writing project or consulting project that we have advised you on.

If you are not satisfied with the final product, you may take advantage of our generous revision policy and we will work until you are 100% satisfied with the final product.

Please note, we do not guarantee specific results as a result of a writing project completed, consulting project or digital course we’ve authored.. While we maintain current industry knowledge and “best practices” for all our services, there are many factors outside of our control that will affect the performance of the written piece(s) we’ve created for you or consulting advice we’ve provided.

We do, however, guarantee that you will be pleased and highly satisfied with the resulting documents we craft for you and/or advice we’ve provided.

Usage Rights for Written Work

Any writing projects created for the purposes of marketing your business or job skills are to be used only for the purpose intended. You may not mis-use or mis-represent any work created for you by The Derenco Agency LLC, including but not limited to selling, extrapolating, or create your own version of or otherwise utilize our work. We maintain the right to showcase the work we created for you as a sample of our work with your identifying personal or business information omitted.

Additional

You represent and warrant that nothing submitted by you to our website or authorized representatives of The Derenco Agency LLC via email or in person shall contain any content which (i) is harassing, defamatory, libelous, abusive, threatening, harmful, vulgar, obscene, racially offensive, sexually oriented, inaccurate, or otherwise objectionable to a reasonable person, (ii) violates any law, rule, or regulation, (iii) infringes, misappropriates, or otherwise violates any copyright, trademark, or other intellectual property right, or any other right of any entity or person, (iv) encourages actions that might constitute a criminal offense, cause civil liability, or otherwise violate any applicable local, state, national, or international law or regulation. You also agree not to impersonate any other person or entity.

Limitation of Liability

By using www.TheDerencoAgency.com, www.WriteYourBook.tips, and/or by contracting our services, you agree that neither The Derenco Agency LLC nor its’ agents will for any reason be liable to you or any other party for any indirect, direct, incidental, consequential, punitive or any other loss or damages, however caused and regardless of character.

You agree to defend, indemnify, and hold The Derenco Agency LLC harmless from and against any and all claims, damages, losses, liabilities, costs, & expenses, (including, but not limited to, attorney’s fees), resulting from your use of the Site and or services.

The Derenco Agency LLC shall not be liable for any damages whatsoever, and in particular we shall not be liable for the following:

a. Any special, indirect, consequential, or incidental damages.

b. Damages for lost profits, loss of revenue, or loss of use, compensatory damages, punitive damages or any and all other damages arising out of or related to the use of our writing, consulting or learning services or website.

c. Information contained in the website, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if The Derenco Agency LLC has been advised of the possibility of such damages.

d. The Derenco Agency LLC shall not be held liable for any loss of income or any and all other damages due to a loss of a position within any organization, company or society as a result of information contained within writing, consulting or learning services provided; it is your responsibility to effectively review the services provide and ensure the information is complete, accurate and a reflection of the exact specifications you desire.

e. The Derenco Agency LLC shall not be held liable for any and all damages as a result of termination from a position within an organization, company or society; or a denial of an interview or position within an organization, company or society as a result of the content or information contained within any written works, learning materials or consulting advice produced by The Derenco Agency LLC and it’s agents. It is the sole responsibility of the client to ensure the contents are accurate to the greatest extent possible prior to utilization.

f. The Derenco Agency LLC shall not be held liable for any and all damages as a result of information contained within the writing, consulting or learning service provided and approved by the client being inconsistent with information contained in the client’s background check when conducted by a third party employer. The Derenco Agency LLC is herein absolved of any and all liability resulting from any negative ramifications imparted upon any clients as a result of such action by any third party employer extending from information contained in the client’s written works, learning materials or consulting advice produced by The Derenco Agency LLC.

g. By using our website and/or services, you are agreeing to these Terms of Service. You agree to be bound by the above limitations of liability and accepts full, total and complete responsibility for ensuring the material, information and all other information contained in written works, learning materials or consulting advice is complete and accurate. SOME JURISDICTIONS DO NOT ALLOW FOR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, THEREFORE SOME OF THE ABOVE LIMITATIONS ARE INAPPLICABLE.

Indemnification

You agree to indemnify and hold The Derenco Agency LLC and its’ agents harmless from any claim or demand, including reasonable attorneys’ fees and costs, loss of income, earnings, compensatory claims, punitive damages, loss of consortium, loss of a position or any and all damages resulting from a denial of a position or denial of an interview for a position made by any third party due to or arising out of your use of our website or services, the violation of this Agreement, or infringement by you, or other user of our website using your computer, of any intellectual property or any other right of any person or entity. Each party shall indemnify and hold the other harmless for any losses, claims, damages, awards, penalties, or injuries incurred by any third party, including reasonable attorney’s fees, which arise from any alleged breach of such indemnifying party’s representations and warranties made under this Agreement, provided that the indemnifying party is promptly notified of any such claims. The indemnifying party shall have the sole right to defend such claims at its own expense. The other party shall provide, at the indemnifying party’s expense, such assistance in investigating and defending such claims as the indemnifying party may reasonably request. This indemnity shall survive the termination of this Agreement.

Arbitration

In the event a dispute shall arise between the — USER (Client) and The Derenco Agency LLC that can not be reasonably resolved between the two parties, it is hereby agreed that the dispute shall be referred to one of the following choices:

a. A specific office to be decided by The Derenco Agency LLC, contained within the State of Georgia to conduct the arbitration proceedings;

b. The Derenco Agency LLC will provide a method of selecting the arbitrator and site of the hearing, such as “from the county wherein the company is located”; or for multi-jurisdictional disputes.

c. A The Derenco Agency LLC office to be designated by The Derenco Agency LLC Headquarters for arbitration in accordance with the applicable United States Arbitration and Mediation Rules of Arbitration. The arbitrator’s decision shall be final and legally binding and judgment may be entered thereon.

Each party shall be responsible for its share of the arbitration fees in accordance with the applicable Rules of Arbitration. In the event a party fails to proceed with arbitration, unsuccessfully challenges the arbitrator’s award, or fails to comply with the arbitrator’s award, the other party is entitled to costs of suit, including a reasonable attorney’s fee for having to compel arbitration or defend or enforce the award.

Warranty Disclaimer

The Derenco Agency LLC, any services offered on or through the website and the software on the site are provided “as is” and “as available” without warranty of any kind whatsoever. The Derenco Agency LLC expressly disclaims all warranties, either expressed or implied, including but not limited to warranties regarding appropriateness for a particular purpose, non-infringement, and any warranties arising out of course of performance.

We make no guarantee that the contents of the site are error-free nor that the site will operate in a manner that is secure (unless otherwise indicated), uninterrupted, or free of viruses or other harmful code beyond our control. The Derenco Agency LLC is not responsible for technical, hardware or software failures of any kind nor for any issues resulting from the same.

Special restrictions on a visitor’s license to access the Website apply to Non-Human Visitors. Non-Human Visitors include, but are not limited to, web spiders, bots, indexers, robots, crawlers, harvesters, or any other computer programs designed to access, read, compile or gather content from the Website automatically. Email addresses on this site are considered proprietary intellectual property. It is recognized that these email addresses are provided for human visitors alone. You acknowledge and agree that each email address our website contains has a value not less than US $50. You further agree that the compilation, storage, and/or distribution of these addresses substantially diminishes the value of these addresses.
